Terms and Conditions of Use and Purchase

Identification of the Provider

The services covered by these Terms and Conditions are provided by Hale S.r.l. - Società Benefit, headquartered at 26 Via Carlo Esterle, 38122 Trento, VAT no. 02763610223, represented by Gaia Salizzoni, hereinafter referred to as the “Provider” or “Hale.”

1. Definitions

1.1. The term “Website” refers to the website www.gethale.it, through which it is possible to view the Services offered, the methods of providing these Services, complete an initial screening test, access Services available online, register on the Hale Platform, and log in.

1.2. The term “Platform” refers to the reserved area that each User may choose to register on to view, select, book, purchase, and use the Services offered and where the User can access all information and documents related to the Services they have used.

1.3. The term “Services” refers to the various services made available on the Website and the Platform, provided by Hale or by a healthcare professional or a healthcare facility affiliated with Hale, which the User can book and/or purchase online and use.

1.4. The term “User” refers to the individual navigating the Website or registering on the Platform, booking, purchasing, and using the Services through the Website or Platform.

1.5. The term “Professional/Healthcare Facility” refers to the professional or healthcare facility providing the service booked and/or purchased by the User.

2. Terms and Conditions of Use

2.1. These Terms and Conditions set out, in clear and simple language, the terms and conditions applicable to the use of the Website www.gethale.it and the Platform by all Users navigating the Website or accessing the Platform and registering by creating their personal account. These Terms and Conditions also govern the methods through which the User uses, books, and remotely purchases the Services offered by the Provider.

2.2. All Users are invited to read these Terms and Conditions carefully before registering, purchasing, and using the services.

2.3. By registering on the Platform and creating their personal account, as well as by purchasing and using the Services, the User declares that they have read and explicitly accepted these Terms and Conditions. In any case, such actions by the User imply tacit acceptance of the Terms and Conditions and subsequent updates.

3. Validity and Modifications

3.1. Hale reserves the right to modify these Terms and Conditions unilaterally and at any time, notifying Users of the changes made.

3.2. Such notification may be made, at the Provider’s discretion, via email to the address provided by the User during registration, a notice viewable on the Website, or any other method that ensures the communication is accessible. Users are required to periodically review any changes made to these conditions.

3.3. Hale also reserves the right to modify, improve, and/or remove the Website's features at any time and unilaterally, without entitling Users to compensation.

4. Ownership of the Website www.gethale.it

4.1. Hale, the sole shareholder of Hale S.r.l., is the exclusive owner of the Website and Platform content, including but not limited to the content of the Services, site architecture, source codes, texts, documents, images, logos, photographs, page layouts, design, know-how, and graphic interfaces.

4.2. The User may not use, copy, reproduce, distribute, publish, or otherwise exploit any features, functionalities, tools, trademarks, or content of the Website, except as explicitly provided for in these Terms and Conditions.

4.3. No content of the Website may be interpreted as licensed or granted for any other usage rights by the Users and/or third parties.

5. Purpose of the Service

5.1. Through the Website www.gethale.it, the User has the opportunity to complete the screening test provided by the Provider, register and access the Platform, and book and purchase Services available via the Website or the Platform after registering and creating a personal account.

5.2. Registering on the Platform allows the User to access a reserved area where the information and documents related to the Services they have booked and used are stored.

5.3. Individual professionals may access the reserved area of Users who have purchased a specific service provided by the professional, with the User's prior consent. Each professional may only view documents related to the Services they have provided.

6. Conditions for Using the Services

6.1. To access the Website and Platform and use the services, the User must have an active Internet connection on their device (costs associated with Internet use depend on the rates agreed upon with their Internet provider).

6.2. The use of Services is permitted exclusively to individual Users aged 18 and above, who have accepted the Terms and Conditions and reviewed and accepted the Privacy Policy.

6.3. The booking and purchase of Services is allowed through the Platform.

6.4. To access Services directly from the Website, the User receives a link in a confirmation email sent to the email address provided during the booking and/or purchase process; using this link, the User automatically logs into their account. Each subsequent login to the account is possible only by using the originally sent link or through the “password recovery” procedure.

7. Platform Registration

7.1. To register on the Platform and create a personal account, the User completes the registration form with their first and last name, email address, and chosen personal password.

7.2. The data entered during registration must correspond to the person using the Services.

7.3. The email address and chosen password are the User’s login credentials, allowing them to access the Platform.

7.4. During registration, the User is asked to accept these Terms and Conditions and confirm they have read the Privacy Policy and provided consent for personal data processing where required.

7.5. Once logged in, the User agrees to keep their password secure and not share it with third parties: login credentials are personal, individual, and non-transferable, even free of charge. It is the User's specific responsibility to take all measures to ensure the confidentiality of their login credentials.

7.6. Registering on the Platform and creating a personal account allows the User to access a reserved area to book and purchase offered Services, access documents such as prescriptions and reports related to the Services used, and share them with professionals delivering the purchased Services.

7.7. Each User is directly responsible for any actions carried out using their account or login credentials and agrees to notify Hale of any unauthorized or abusive use of their account and/or login credentials. Hale cannot be held responsible for any damages of any kind suffered by the User resulting from unauthorized or abusive use of the account (and/or the User's login credentials) by third parties.

7.8. For account or password-related issues, the User can contact Hale by sending an email to hello@halecommunity.com.

8. Booking, Purchase, and Payment of Services

8.1. The User can book and purchase the Services offered by the Provider on www.gethale.it via the Website or the Platform.

8.2. The contract for purchasing the various Services is concluded exclusively online, where, by following the indicated procedures, the User formalizes the “online purchase contract.”

8.3. The online purchase contract is concluded through the User's consent to purchase, expressed via online submission, after viewing a summary page of the purchased service, the cost of the service, any additional charges, and the withdrawal terms.

8.4. Once the Provider receives the User’s consent to purchase, it sends a confirmation and summary email, detailing the information outlined in the previous point.

8.5. The contract is not considered finalized and effective between the parties if the actions outlined in the previous point are not completed.

8.6. The cost of each Service is specified on the Website and Platform and includes applicable taxes and fees. The cost of Services may change over time, but changes will not affect orders already placed by the User.

8.7. The procedure for purchasing Services concludes with payment, which can be made via Stripe or PayPal.

8.8. All payment-related communications are secured using Secure Sockets Layer (SSL) technology to protect credit card data.

8.9. Credit card data entered on the Website or applications is stored and processed by Stripe or PayPal, which are contractually committed to complying with all rules, standards, and guidelines adopted or required by credit card brands or the Payment Card Industry Security Standards Council, including data security measures and protection standards.

9. Billing

9.1. The Website or Platform automatically generates an invoice that identifies Hale S.r.l. and the User in the case of Services provided by Hale or the Professional/Healthcare Facility and the User in the case of Services provided by the Professional/Healthcare Facility. The invoice will be made available to the User on the Platform within 12 days of payment; the User can download it independently.

9.2. In certain cases of services booked through the Platform and provided in person by the Professional, the Professional will issue the invoice to the User.

10. Provision of Services

10.1. After completing the purchase, the User can use the Services according to the methods described on the Website or Platform for each Service.

11. Liability

11.1. Hale cannot be held liable or jointly liable for any professional liability arising during or resulting from the healthcare service provided by the Professional/Healthcare Facility.

11.2. Under current laws, the professional liability for the healthcare service lies with the licensed professionals or authorized facilities providing the clinical service. Therefore, no claims can be made against Hale.

12. User Rights and Obligations

12.1. By accepting these Terms and Conditions, the User:

  • Confirms they are over 18 years old or acting as a parent or legal guardian of a minor;
  • Confirms they have agreed to provide their personal data to register on the Platform, create a personal account, and purchase and use the available Services;
  • Ensures that the information provided to Hale is correct and truthful. If incorrect or false information is found, Hale reserves the unconditional right to delete the account without explanation and deny the User access to the Platform. Users who are denied access for these reasons are prohibited from creating a new account;
  • Agrees to use the Website and Platform solely for their intended purposes, which is to enable access to the offered Services;
  • Refrains from engaging in the following activities:
    • Modifying the Website or Platform and/or creating derivative works based on the Website;
    • Circumventing systems used by Hale or its licensors to protect the content accessible through them;
    • Copying, in any way, any content provided by Hale via the Website or Platform or during the provision of Services;
    • Violating data protection rights of any party.

12.2. Each User is responsible for how they use the Website and Platform and the information they enter into their account.

12.3. In case of disputes by third parties regarding any data, content, or conduct by the User through the Website or Platform, the User assumes full responsibility, both toward third parties and Hale.

12.4. Users may report any issues related to the operation or use of the Website or Platform by emailing hello@halecommunity.com.

13. Disclaimer

13.1. Hale is not liable for any errors (including material errors) and/or interruptions in the operation of the Website or Platform not attributable to it.

13.2. Hale does not guarantee and disclaims all liability, within legal limits, for any damages, direct or indirect, arising from the use or inability to use the Website or Platform for reasons not attributable to it.

13.3. Hale is not liable to Users for damages resulting from non-compliance by operators of electronic communication services, with whom Users have contractual relationships, with legal and contractual provisions applicable to transmitting signals to or from Users.

13.4. Any legally mandatory liabilities are limited to the use of the Website and Platform, explicitly excluding responsibility for any direct and/or indirect damages resulting from Users’ conduct or unauthorized data access by third parties.

13.5. Hale is not responsible for any inability to access and/or use the Website and/or Platform due to Internet connection issues or technical malfunctions.

13.6. Hale assumes no liability for damages, claims, or losses, direct or indirect, arising from the failure and/or malfunctioning of third-party electronic equipment or telephone/telematic connections not managed directly by Hale or its suppliers.

14. Service Limitations

14.1. Hale reserves the right to modify, suspend, or terminate Services in whole or in part at any time, even without prior notice.

14.2. For example, this may occur due to the User’s device lacking an Internet connection, server malfunctions, issues with services provided by third-party suppliers, other electronic devices not part of the Internet network, software malfunctions, computer viruses, or actions by hackers or other Users with network access.

14.3. Hale will keep Users informed about any service suspensions and/or interruptions via email communication to the address used during registration.

15. Right of Withdrawal

15.1. The User has the right to withdraw from the purchase of Services within 14 days of purchase.

15.2. If the User consents to the service beginning during the period mentioned in Article 15.1, the right of withdrawal is forfeited.

15.3. If the User decides to exercise the right of withdrawal outlined in Article 15.1 before the service begins, they must notify Hale by email at hello@halecommunity.com.

15.4. Upon receipt of the withdrawal notice, the parties to this contract are released from their mutual obligations.

15.5. The User may request account deactivation and registration termination at any time, for any reason, by sending an email to hello@halecommunity.com.

15.6. Following the deactivation request, Hale will deactivate the User’s account and delete all registered personal data, except for data that must be retained in compliance with legal obligations.

16. Personal Data Processing

16.1. The Website www.gethale.it and the Platform comply with current regulations on personal data processing. User data is processed in accordance with the GDPR (General Data Protection Regulation, EU Reg. 2016/67) and Legislative Decree No. 196/2003 ("Privacy Code"), as amended by Legislative Decree 101/2018.

16.2. By selecting the appropriate “flag,” the User consents to the processing of their personal data for the purposes and methods specified in the Privacy Policy.

16.3. The User’s data will only be used for the purposes outlined in the Privacy Policy and as authorized by the User.

17. Partial Nullity

17.1. If any clause or part of these Terms and Conditions is deemed null, illegal, or invalid, the remainder of the contract will remain unaffected, preserving its validity and effectiveness.

18. Governing Law and Jurisdiction

18.1. The relationships between Hale and Users are governed by the laws of the country where the User habitually resides. For any disputes related to the Terms and Conditions, given the User’s status as a consumer, the provisions of Legislative Decree 206/2005 will apply, and jurisdiction will lie with the court in the location indicated by the User as their residence or domicile.

18.2. To resolve disputes out of court relating to the Terms and Conditions governed by Sections I through IV of Chapter I, Title III, Part III of the Consumer Code and concerning the Terms and Conditions of Use, the User may seek mediation as outlined in Legislative Decree No. 28/2010 or turn to ADR organizations via the Online Dispute Resolution (ODR) platform established and managed by the European Commission, accessible at http://ec.europa.eu/consumers/odr/.
